Policy Regarding the Digital Millennium Copyright Act

Informing Us About Infringement

  3. Details of the material claimed to be infringing, along with the page URL to aid in identification;
  4. Contact information of the complaining party including name, address, email, phone, and fax;
  5. A statement expressing a genuine belief that the material is being used without authorization;
  6. A declaration that the information provided is accurate, and, under penalty of perjury, that the complainant is authorized to represent the copyright owner.

Section 17 USC §512(f) outlines the civil penalties for misrepresentation of information in infringement notifications.

How to Restore Removed Material

If you receive a notice of takedown due to a copyright claim, you can issue a counter notification to have the material reinstated on the site. This notification must include:

  1. Your signature, whether electronic or physical;
  2. A description of the removed material and its original location;
  3. A statement, under penalty of perjury, that you believe the material was taken down due to error or misidentification;
  4. Your name, address, phone number, along with your consent to the jurisdiction of the federal district court and acceptance of service of process.
